The Australian Department of Home Affairs has unveiled plans to grant a six-month renewal window for skilled worker visa holders starting July 1, 2024. This change comes as part of significant revisions to visa conditions 8107, 8607, and 8608, aiming to tackle unfair labor practices and enhance labor market mobility for temporary migrants.
Key Visa Changes
The updates specifically affect holders of the Temporary Work (Skilled) visa (subclass 457), Temporary Skill Shortage visa (subclass 482), and Skilled Employer Sponsored Regional (Provisional) visa (subclass 494). Under the new regulations, if visa holders cease employment with their sponsoring employer, they will have up to 180 days (six months) at a time, with a cumulative maximum of 365 days (one year) during the visa period, to secure new sponsorship, apply for a new visa, or arrange departure from the country.
During this grace period, visa holders are allowed to work for other employers, including in occupations not listed in their most recent sponsorship nomination. This flexibility enables them to sustain themselves while seeking new sponsorship.
Employer and Visa Holder Responsibilities
Sponsors must notify the Department of Home Affairs of any changes in the visa holder’s employment status within 28 days. Visa holders are prohibited from engaging in work that does not comply with the license or registration requirements for their nominated occupation.
These changes apply to existing visa holders and those granted a visa on or after July 1, 2024. Any periods a visa holder stopped working for their sponsor before July 1, 2024, will not count towards the new time limits.
Australia’s Comprehensive Migration Strategy
In addition to these visa changes, the Australian government introduced a comprehensive migration strategy on December 11, 2023. This strategy includes eight key actions and over 25 policy commitments aimed at reforming the migration system to attract international talent and address labor shortages.
On May 14, 2024, the government announced the 2024-25 permanent Migration Program, set at 185,000 places. This program focuses on filling labor gaps, especially in regional Australia, where shortages are more severe. Prioritizing visa processing for these areas aims to distribute migration benefits more evenly across the country.
